IEA not facing any constitutional gap as all issues handled based on Sharia

Although the leadership of the Islamic Emirate of Afghanistan has been discussing the development
of a constitution for the country since the IEA took over, the spokesman to the Islamic Emirate of Afghanistan also emphasized on development of the constitution last year. But the discussions about the mentioned issue are still going on.

Officials of the Islamic Emirate of Afghanistan (IEA) say that work is underway to draft the constitution. The IEA spokesperson has said that governance is currently being handled on the basis of Sharia law, and work is underway to draft the constitution for the country. This comes as the citizens of Afghanistan want the Islamic Emirate of Afghanistan to develop the constitution. Some Afghan citizens in their interviews with The Kabul Times correspondent said that having a constitution is one of the valid pledges for the Afghan people. Therefore, a good government is one that has a constitution. “This is a good opportunity for the world to recognize the Islamic Emirate of Afghanistan. The IEA is going to take some measures, including the development of the constitution for the country, to be recognized by the International Community. The world should no longer have an excuse not to recognize the Islamic Emirate,” said Shahriar, a resident of Kabul city, after he welcomed the fact that the IEA is in the process of drafting a constitution. However, the spokesman to the Islamic Emirate Zabihullah Mujahid, told the media a few days ago that the current government is not facing a constitutional vacuum. “Legal issues are also important, and, God willing, the work on it is ongoing and we are moving toward it slowly but the things that are in the priorities will be focused on,” Mujahid said. In addition, a number of political experts said that having a constitution is essential for a country. “The national pledge in each government has a central alternative; for example, the duties of citizens and the government responsibility are defined based on this national document. The lack of a constitution undoubtedly endangers the political life of a government,” said Sayed Muqadam Amin, a political analyst. “Due to having a constitution in a government, the world interacts with each other and makes good ties in each aspect of the government accordingly,” said a lawyer. According to him, the Constitution is the most important legal document and source of legislation in which justice, freedom, and citizenship rights are recognized and regulated. It is expected that the IEA focuses on drafting the constitution as soon as possible so that the Afghan people can have the constitution for their country. According to the lawyers, a constitution is essential for sovereigns. They hope that a constitution based on Sharia law will be created so that the injustice in the society will be removed. It is worth noting that the basic principles in the constitution are based on justice and equality and having a government according to the principle of meritocracy.
